General Terms and Conditions of Le Domaine des Trois Tilleuls
Article 1 – Scope of the General Terms and Conditions
These general terms and conditions apply to and form an integral part of any contract relating to tourist stays concluded between SRL B-ios, whose registered office is located at 1490 Court-Saint-Etienne, Rue de Sart 55, and registered with the Crossroads Bank for Enterprises under No. 0798.212.010 (hereinafter “Domaine des Trois Tilleuls”), and its clients (hereinafter the “Guests”).
Article 2 – Booking Conditions
2.1 Price and Payment
The price of the stays is indicated in euros, including VAT and tourist taxes.
At the time of booking, the full price of the reservation must be paid. Any option for which payment has not been made within 7 days will be automatically canceled.
In the event of late payment of the balance, the reservation may be canceled without prior notice, without prejudice to Domaine des Trois Tilleuls’ right to demand full payment of the reservation from the Guest.
2.2 Withdrawal
The legal provisions concerning the right of withdrawal in the case of distance selling, as provided by the Code of Economic Law, do not apply to tourist services. Therefore, the Guest does not have any right of withdrawal for any booking of a stay with Domaine des Trois Tilleuls. (art. VI.53, 12° Code of Economic Law ).
2.3 Reservation cancellations and changes
a) Reservations can be canceled or modified up to 30 days before the stay date. Administrative fees of 20 euros may be deducted from the refunded amount.
b) Guests are advised to take out or verify if they already have cancellation insurance that allows them to obtain a refund of the amounts paid in case of stay cancellation or early departure under certain conditions (illness, accident, etc.).
c) Reservations are personal and Guests are prohibited from transferring their reservation to a third party for any reason, unless with prior written consent from Domaine des Trois Tilleuls.
2.4 Cancellation of the stay by Domaine des Trois Tilleuls:
Domaine des Trois Tilleuls reserves the right to preemptively cancel a reserved stay, even if it has already started, if one of the following criteria is met:
Weather conditions that jeopardize the Guest’s safety during their stay.
Malfunction of the wastewater treatment system requiring temporary closure of the cabin until repairs are completed.
In such a case, Domaine des Trois Tilleuls commits to finding an alternative solution in discussion with the Guest.
If no alternative solution is suitable for the Guest, or upon their request, a full refund of their stay (minus the service(s) or full night(s) already consumed) will be considered a fair solution and accepted de facto by both parties, without the possibility of appeal against this resolution.
Article 3 – Stay Procedure
3.1 Arrivals and Departures
Arrivals take place from 4:00 PM on Mondays, Wednesdays, and Fridays. There are no arrivals on Tuesdays, Thursdays, Saturdays, and Sundays. Departures must be made before 11:00 AM on Wednesdays and Fridays, and before 5:00 PM on Sundays.
3.2 Delay in Returning the Keys
Any key return after the time specified in Article 3.1 will result in the billing of an additional night. Any request to extend the stay must be made at least 24 hours before the scheduled departure date.
3.3 Internal Regulations
To ensure a pleasant stay for all Guests, they must comply with the rules (of conduct) mentioned in the Internal Regulations. These regulations can be consulted on the website. Any violation of the Regulations may result in expulsion from the domain, without a refund of all or part of the booking price.
Guests are responsible for ensuring compliance with these Internal Regulations by any individuals they have allowed onto the domain.
3.4 Number of Guests
The number of Guests must under no circumstances exceed the maximum capacity specified in the reservation.
If this occurs, Domaine des Trois Tilleuls reserves the right to cancel the reservation (without refund), terminate the stay (without refund), and/or adjust the rental price.
Article 4 – Liability
The Guest listed as the contact person for the reservation is responsible for the actions and any potential damage caused by other Guests under their reservation.
Except in cases of gross negligence or intentional misconduct, Domaine des Trois Tilleuls is not liable for:
– theft, loss, or damage of any kind during or after the stay,
– equipment defects or malfunctions during the stay.
Domaine des Trois Tilleuls also disclaims any responsibility in the event of an accident in the cabins, the guesthouse, a seminar space, and/or anywhere on the Domaine des Trois Tilleuls property.
The Guest and their companions must use the accommodation and facilities provided by Domaine des Trois Tilleuls responsibly.
If the Guest or one of their companions is responsible for any damage, they must report it immediately to Domaine des Trois Tilleuls. Domaine des Trois Tilleuls reserves the right to charge the value of the damaged item and/or the cost of repairs.
At the start of the stay, the Guest is required to check the condition of the accommodation (cabin, guesthouse, seminar space) and its equipment upon receiving the keys. If no defects are reported to Domaine des Trois Tilleuls (by phone or SMS) at the beginning of the stay, the accommodation and its equipment will be considered to have been provided in perfect condition.
The cleaning of the accommodation at the end of the stay is included in the booking price. However, if the accommodation has not been used responsibly and is found in an unusually dirty state, additional cleaning fees may be charged.
Domaine des Trois Tilleuls is not responsible for any damages, accidents, or thefts occurring on the property.
The use of water facilities (pool, sauna, and natural pond) is under the responsibility and supervision of the Guest managing the reservation. These facilities are unsupervised and are prohibited for minors without accompaniment. Domaine des Trois Tilleuls disclaims all responsibility in the event of an accident.
Article 5 – Force Majeure
Domaine des Trois Tilleuls is not liable for any loss or damage resulting from delay or failure to fulfill a contractual obligation when such delay or failure is due to force majeure.
Force majeure includes any unforeseeable event beyond the control of Domaine des Trois Tilleuls, such as, but not limited to, any natural disaster, epidemic, fire, accident, war, uprising, riot, act of terrorism, spontaneous work stoppage or slowdown, lockout, changes in market conditions, failure of telecommunication or electricity lines, act of government, or order from a court or public authority.
Article 6 – Complaints
Complaints during the stay must be reported on-site to the reception as soon as possible so that a solution can be found.
If a complaint cannot be resolved satisfactorily or if the Guest is unable to make their complaint on-site, they must communicate their complaint no later than 14 days after the end of the stay by email to hello@ledomainedestroistilleuls.be or by postal mail to Rue de Sart – 55, 1490 Court-Saint-Etienne.
Article 7 – Personal Data – Privacy
Domaine des Trois Tilleuls processes your data in compliance with the General Data Protection Regulation (GDPR) and its Privacy Statement available on its website.
Article 8 – Applicable Law – Competent Jurisdiction
These general terms and conditions are governed by Belgian law, and any dispute regarding their application falls under the jurisdiction of the courts of the Nivelles district.
